The Ministry of Local Government, Public Works and National Housing says it will not accept the High Court order to reinstate suspended Gweru Mayor, Hamutendi Kombayi and 10 other councillors.
The High Court made a ruling following an urgent chamber application for reinstatement of the council executive, dated 22 September.
The order for reinstatement was handed down by Justice Nokuthula Moyo at the Bulawayo High Court on the 1st of October.
Kombayi and the 10 councillors were suspended indefinitely in August by Minister Saviour Kasukuwere on allegations of gross misconduct, incompetence and mismanagement of council funds and affairs.
Justice Moyo handed the order citing section 114 of the Urban Councils Act used by Minister Kasukuwere in suspending the councillors and to appoint a tribunal was inconsistent with Section 278 of the constitution.
The constitution provides for an independent tribunal to exercise the function of removing from office mayors, councilors and council chairpersons.
